What is the LPA statutory duty with regards to consultation?

When a new application is submitted the LPA has a statutory duty to identify the relevant statutory consultees (ie Natural England, Environment Agency) and request for their opinion on the submitted proposals. These consultees could also be part of the LPA’s internal departments (ie Landscape Architect, Highways). They will make a judgement on the proposals and return their report back to the LPA.

The LPA will then assess the individual reports along with its own assessment and make a decision on the application.
