What type of reason would allow for an extension of time?

An extension of time would be justifiable for anything that is classed as unforeseeable and that the contractor would have been able to deal with it without any delay had it been an obvious issue. Anything beyond reasonable control by the contractor could justify an extension, only if it affects the overall duration of the schedule and the programme.

In order for the extension to be justifiable, it needs to be included in the list that each contract allows for. The formal procedure also needs to be followed by the contractor, as described in the contract.

Typical unforeseeable circumstances include:

  • extreme weather
  • strikes
  • terrorism
  • force majeure
  • situations away from the Contractor’s control.

Also, if a variation issued by the Contract Administrator involves a significant amount of extra work, the contractor will be entitled to an extension of time.
